Canada’s Federal Court has rejected Amnesty International’s bid to have the Charter of Rights and Freedoms apply to Afghan detainees captured by Canadian soldiers.

“Everyone has the right to life, liberty and security of person under the Charter and international law. Individuals detained by Canadian Forces must not face the threat of torture after being transferred,” Alex Neve, Secretary General of Amnesty International Canada, said in a press release last year.
Apparently, according to the Canadian Prime Minister and the SCoC, not everyone does…. and Canada is reduced further as a [supposedly] civilized nation because of that.

Can you explain to me 2 things?
First off, what exactly in the Charter of Rights and Freedoms is being threatened by Canadian military forces?
Secondly, where does it state in the Charter of Rights and Freedoms that foreign citizens who are captured outside of Canadian territory and transferred to the local government control are covered under the Charter?
