Kansas appeals court backs harsher sentence for illegal gay sex, says difference justifiable
Kansas can punish illegal sex with children more harshly when it involves homosexual acts, the state Court of Appeals ruled Friday in a case being watched by national advocacy groups.
So which is it Judge? Are homosexual sex offenses somehow worse that heterosexual offenses, or is it that heterosexual sex offenses are more acceptable than homosexual ones? Red Foreman has a great line for something like this - Judge, you’re a dumb ass.
Judge Henry W. Green Jr. wrote in the 2-1 decision that legislators could justify differing penalties for homosexual versus heterosexual sodomy in plenty of ways, including greater health risks or an attempt to “encourage and preserve the traditional sexual mores of society.”
Ah yes, it’s infinitely important to send the message that traditional sexual assault is no where near as wrong or unacceptable as homosexual assault - as opposed to sending the message that sexual assault is just plain wrong. This from one of the states that also wants to toss adults into jail for consensual homosexual sex.
